Terms and Conditions

These Terms and Conditions govern your use of the Serbian Studio website and the purchase of goods from us. By placing an order, you agree to be bound by these terms. Please read them carefully before purchasing.

These terms do not affect your statutory rights under Australian Consumer Law.

2. Your Account

1. When you register on the Serbian Studio website, you will choose an email address and password. You are responsible for all activity and transactions made under your account credentials. Keep your password secure and do not share it with anyone.

2. If you believe your account has been compromised, please change your password immediately and notify us at hello@serbianstudio.com.au.

3. If any of your details change (such as your billing address), you may update them by logging into your account.

 

3. The Contract Between Us

1. Any contract for purchases made through serbianstudio.com.au is with Serbian Studio (ABN 27 548 375 320).

2. Payment of the full price must be received before your order can be accepted. Payment is taken in Australian Dollars (AUD) at the time of placing your order. Once payment is received, we will send you an order confirmation email to the address you provided. This confirmation constitutes acceptance of your order and forms a legally binding contract between us.

3. If an error or inaccuracy is discovered regarding the advertised price or description of any goods, we will contact you by email as soon as possible. You may then choose to proceed at the corrected price or cancel your order for a full refund.

 

4. Your Right to Cancel

1. You may cancel your order without giving a reason at any time before the goods are dispatched. To cancel, please contact us at hello@serbianstudio.com.au as soon as possible.

2. If your cancellation is received before dispatch, we will refund the full amount within 3 business days using the same payment method you used.

3. If the goods have already been dispatched, please refer to our Returns and Refunds policy on our Shipping & Returns page at serbianstudio.com.au/shipping-returns.

4. Special orders (items sourced specifically at your request) may not be cancelled once the order has been placed with our supplier. We will advise you of this at the time of ordering.

 

5. Availability of Goods

Some stock is subject to availability. We update our website as promptly as possible when items sell out, though this process may take a few hours.

If we have insufficient stock to fulfil your order, we will notify you promptly. You may choose between a full refund or waiting for the item to return to stock. If you choose a refund, it will be processed within 30 days of your order using the original payment method. We are not obliged to offer additional compensation for inconvenience.

 

6. Delivery

We will dispatch your order to the address provided at the time of purchase. Delivery will be made as soon as reasonably possible and in any event within 30 days of your order being accepted.

All delivery timeframes shown on our website are estimates only, based on normal processing times and the delivery carrier. We are not responsible for delays caused by postal or courier services.

Ownership and risk of the goods pass to you upon dispatch from our premises.

 

7. Pricing, GST and International Orders

All prices displayed on our website are in Australian Dollars (AUD) and are inclusive of Australian GST (10%).

Goods dispatched to addresses outside Australia are not subject to Australian GST. However, when ordering for international delivery, you may be subject to import duties, taxes, and customs clearance charges levied by your country. These additional charges are your responsibility. We have no control over these costs and cannot predict what they may be. Please contact your local customs authority for information before ordering.

When ordering goods for international delivery, you are considered the importer of record and must comply with all applicable laws and regulations in your country.

 

8. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms and Conditions is intended to exclude, restrict, or modify any rights or remedies you may have under the Australian Consumer Law or any other applicable legislation. To the extent that any provision of these Terms is inconsistent with your statutory rights, your statutory rights prevail.

 

9. Our Liability to You

1. If the goods we deliver are not what you ordered, are damaged or defective, or the delivery is of an incorrect quantity, please notify us in writing at hello@serbianstudio.com.au within a reasonable time of receiving the goods. We recommend doing so promptly and no later than 30 days of delivery.

2. If you do not receive goods within 30 days of dispatch, please notify us in writing within 45 days of the dispatch date.

3. Subject to your rights under Australian Consumer Law, our obligation upon receiving a valid complaint will be to: make good any shortage or non-delivery; replace or repair damaged or defective goods; or refund the amount paid for the goods in question.

4. If goods are reported stolen at or near your delivery address, we may ask you to assist us by providing a police report number. We will assess each case on its merits and in accordance with our obligations under Australian Consumer Law.

5. To the extent permitted by law, we will not be liable for any indirect or consequential loss or damage arising from any issue with your order, beyond refunding the amount you paid.

 

10. Force Majeure

Serbian Studio will not be liable for any failure or delay in delivering your order caused by events beyond our reasonable control, including but not limited to natural disasters, strikes, pandemics, supply chain disruptions, or carrier delays.

 

11. Website Disclaimer

Our website and its contents are provided in good faith. While we take care to ensure accuracy, we do not warrant that all information on our website is complete, current, or error-free. We reserve the right to correct any errors or update content without notice.

To the extent permitted by law, Serbian Studio excludes all liability for any loss or damage arising from your use of this website. This does not affect your statutory rights as a consumer.

Our website may contain links to third-party websites. We have no control over the content of those sites and accept no responsibility for them.

 

12. Intellectual Property

All content on this website, including text, graphics, logos, and images, is the property of Serbian Studio or its content suppliers and is protected by Australian copyright law. You may not reproduce, distribute, or use any content from this site without our prior written permission, except for personal, non-commercial purposes such as placing an order.

The Serbian Studio business name and logo are our property. All other trademarks and logos referenced on this site belong to their respective owners.

 

13. Complaints

We take complaints seriously and aim to resolve all disputes promptly and fairly. If you have a complaint, please contact us at hello@serbianstudio.com.au and we will respond within 5 business days.

If you are not satisfied with our response, you may contact the Australian Competition and Consumer Commission (ACCC) at www.accc.gov.au or your relevant state consumer affairs office.

 

14. Governing Law

These Terms and Conditions are governed by the laws of Australia. Any disputes arising from these terms or your use of our website shall be subject to the exclusive jurisdiction of the Australian courts.

 

15. Entire Agreement

These Terms and Conditions, together with our current website prices, delivery details, Shipping & Returns policy, and Privacy Policy, constitute the entire agreement between you and Serbian Studio relating to the supply of goods. These terms may not be varied except in writing signed by the owner of Serbian Studio.

 

16. Definitions

In these Terms and Conditions:

1. 'Serbian Studio', 'we', 'us' or 'our' means Serbian Studio (ABN 27 548 375 320) and any successor to its business.

2. 'You' and 'your' means the person ordering goods under these terms and conditions.

3. 'Business day' means every day of the calendar year apart from weekends and Australian public holidays.

4. 'Australian Consumer Law' means Schedule 2 of the Competition and Consumer Act 2010 (Cth).
